The foreclosure defense forms you purchase here are based on actual pleadings, motions, and discovery filed by me in actual Florida mortgage foreclosure cases. Feel free to use the forms only for your own personal use. You may not sell them or give anyone else access to them.

Please note, you should have a mortgage attorney represent you or assist you in your foreclosure defense. The laws and court procedures that may apply to you are complex and varied and are not necessarily contained in these forms. This is especially true if your foreclosure action is not brought in Florida.

The forms are numbered in groups. Form group 1 is filed first. Only if there is a default entered for failure to respond to the foreclosure complaint is 1b filed (Motion to Vacate Default). When the RESPA information demanded from group 1 is received, form 2 is filed if there is a basis to move to dismiss the foreclosure complaint. When an answer is due (no basis to file motion to dismiss foreclosure complaint or motion to dismiss foreclosure complaint denied), form 3 is filed which also includes a mortgage fraud claim against the mortgage lender if the foreclosure was filed by a trust. Finally, form group 4 is filed to take discovery from the mortgage foreclosure party suing.
